Eleventh Circuit Rejects FCA Retaliation Claim Against IRF

The Eleventh Circuit rejected August 31 a physician’s retaliation claim under the False Claims Act (FCA) against various HealthSouth entities that operate a for-profit inpatient rehabilitation facility (IRF) in Sarasota, FL because the whistleblower failed to show she possessed a “reasonable belief” that the hospital violated the FCA by allegedly using fraudulent diagnosis codes.
