State Health Care Fraud Law Toolkit: 50-State Survey with Summaries and Links

AHLA's updated Fraud and Abuse 50-State Survey summarizes the fraud and abuse statutes, regulations, and other pertinent authorities for each state. Most states have specific laws and regulations on these subjects, and while many are similar and often borrow from federal authorities, each state uses its own terminology and thresholds for governmental oversight. This updated survey aims to make the process of legal research more efficient and to serve as a primer for those new to fraud law.

Stark Law Toolkit

The Stark Law Toolkit aggregates the federal physician self-referral law (or “Stark Law”) statutory text, regulatory text, all the significant rulemaking from 1992 to the publication date of the Toolkit (including questions and CMS commentary), Stark Law advisory opinions, and Stark Law FAQs. The Toolkit also includes an index covering CMS commentary on all Stark Law exceptions and fundamental terminology (e.g., “fair market value”). The index provides citations to every substantive discussion of the applicable exception or fundamental term across all applicable Federal Register issuances.

Anti-Kickback Statute Toolkit

The Anti-Kickback Statute (AKS) Toolkit collects a broad array of primary source materials concerning the AKS. The resources include: the statute; implementing regulations; an overview of the Sprint Rule; guidance from the U.S. Department of Health and Human Services Office of Inspector General (OIG); Advisory Opinions issued by OIG and accompanying summaries; and key case summaries from each of the federal circuits.
