U.S. Court in Florida Refuses to Dismiss Whistleblower Action Alleging Allergy Testing Kickback Scheme

BioTek Labs, LLC and its senior executives must face allegations they violated the Anti-Kickback Statute (AKS) by offering medical providers free or low-cost supplies, personnel, training, and equipment to induce their referrals of allergy testing and treatment services to the company and caused the submission of false claims, the U.S. District Court for the Middle District of Florida held January 24.
