Fifth Circuit Says Medicare Provider Dispute over Improperly Recouped Funds Is Reviewable

The Fifth Circuit revived January 3 a Medicare provider’s lawsuit against the Department of Health and Human Services (HHS) seeking repayment of improperly recouped funds after finding the action was a continuation of an initial, properly exhausted administrative appeal.
