Third Circuit Rejects Whistleblower Action Against Bayer, J&J Alleging Fraudulent Inducement of Antibiotic Approvals

The Third Circuit affirmed April 10 the dismissal of a whistleblower action alleging Bayer Corporation and Johnson & Johnson (J&J) fraudulently induced the Food and Drug Administration (FDA) to approve their antibiotics by omitting or misrepresenting serious side effects during the drug approval process resulting in the submission of false claims to federal health care programs.
