U.S. Court in Maryland Allows Whistleblower Action Against Medical Device Makers Alleging Kickback Scheme

A relator was finally successful in advancing his whistleblower action under the False Claims Act (FCA) alleging two medical device manufacturers—Allergan, Inc. and Apollo Endosurgery, Inc.—provided surgeons valuable free advertising to induce them to recommend defendants’ LAP-BAND product for treating obesity.
