Navigating False Claims Act Developments and Risk in the Medicare Advantage Program in 2025 and Beyond

The Medicare Advantage Program (MA Program), also known as Medicare Part C, is the largest component of Medicare, both in terms of federal dollars spent and the number of beneficiaries impacted. Over the last 15 years, the share of eligible Medicare beneficiaries enrolled in the MA Program has more than doubled. In 2024, 33.6 million people—more than half of all eligible Medicare beneficiaries—were enrolled in the MA Program, and the Centers for Medicare & Medicaid Services (CMS) paid MA Plans nearly half a trillion dollars. This growth is not likely to slow anytime soon. In April 2025, CMS announced that payments from CMS to MA Plans are expected to increase on average by 5.06% from 2025 to 2026.
