FTC Isn’t Relaxing Scrutiny of “Failing Firm” Defense, Official Warns

The Federal Trade Commission (FTC) will continue to apply the same strict conditions to deals that assert a “failing firm” defense to clear merger review during and after the COVID-19 pandemic, according to a May 27 blog post by Bureau of Competition Director Ian Conner.
