U.S. Court in California Tosses Nursing Home Residents’ Action Against State Alleging Violation of Federal Rights

A federal court in California granted March 10 summary judgment in favor of the California Secretary of Health and Human Services in a 42 U.S.C. § 1983 action for allegedly violating federal rights by failing to provide a “fair mechanism” for hearing transfer and discharge appeals of nursing home residents who alleged they were subject to unlawful "dumping" by a Medicaid-covered facility.
