U.S. Court in Maryland Rejects Whistleblower Action Against Medical Device Makers Alleging Kickback Scheme

A federal court in Maryland dismissed September 10 without prejudice a qui tam action under the False Claims Act (FCA) alleging that two medical device manufacturers provided surgeons valuable free advertising on their website to induce them to recommend defendants’ LAP-BAND product for treating obesity.
