U.S. Court in Ohio Refuses to Compel Arbitration of Nursing Home Negligence Action

The U.S. District Court for the Northern District of Ohio denied Trilogy Healthcare of Allen’s motion to compel arbitration of a negligence action brought by a deceased resident’s estate. The court found that Trilogy failed to show plaintiff, the resident’s daughter, had actual or apparent authority to enter into a valid arbitration agreement on her mother’s behalf.
