The culmination of the Trump administration’s efforts to reform the Stark Law were published on December 2, 2020 in the form of amendments to the physician self-referral law regulations. This effort, which first began two-and-a-half years prior with a solicitation of comments from the public on the Stark rule, produced another 150 pages of three-columned Federal Register commentary, countless amendments to the regulatory text, and three new exceptions. Much has been written about how these new regulations remove regulatory barriers and adopt objective tests for providers to determine compliance.
