U.S. Court in Maryland Again Rejects Whistleblower Action Against Medical Device Makers Alleging Kickback Scheme

A federal court in Maryland again dismissed a qui tam action under the False Claims Act (FCA) alleging two medical device manufacturers—Allergan, Inc. and Apollo Endosurgery, Inc.—provided surgeons valuable free advertising to induce them to recommend defendants’ LAP-BAND product for treating obesity.
