Fifth Circuit Won’t Compel Arbitration Between Hospital and Plan Administrator Who Didn’t Have Direct Contract

The Fifth Circuit June 17 declined to compel arbitration in a payment dispute where the treating hospital and the health plan administrator did not have a direct contract. Although the two parties were connected by a web of network contracts, the appeals court affirmed the lower court’s finding that the plan administrator had no knowledge of the arbitration provision in one of the hospital’s related contracts.
