Ninth Circuit Holds LCDs Not Subject to Notice and Comment Requirements

A divided Ninth Circuit panel held July 16 that the Medicare Act’s notice and comment requirements do not apply to Local Coverage Determinations (LCDs) made by Medicare contractors because LCDs do not establish or change a substantive legal standard.
