HHS Issues Final Rule Partially Updating 42 CFR Part 2; More Changes to Come

On July 13, 2020, the Substance Abuse and Mental Health Services Administration (SAMHSA) within the U.S. Department of Health and Human Services (HHS) issued a Final Rule amending 42 CFR Part 2 (Part 2) regulations, which govern the privacy of substance use disorder (SUD) treatment records created by federally assisted health care providers. The final rule comes ahead of HHS implementing more comprehensive changes mandated in Section 3221 of the Coronavirus Aid, Relief and Economic Security Act (CARES Act), signed into law on March 27, 2020. The CARES Act requires HHS to further revise Part 2 rules by March 27, 2021.
