Mallinckrodt to Pay $260 Million FCA Settlement to Resolve Medicaid Rebate, Kickback Allegations

Mallinckrodt ARD LLC, formerly Questcor Pharmaceuticals, will pay $260 million to resolve two separate actions under the False Claims Act alleging the drug maker knowingly underpaid Medicaid rebates for its drug H.P. Acthar Gel and used a foundation as a conduit to pay illegal kickbacks in the form of copay subsidies for Acthar, the Department of Justice announced March 7.
