Seventh Circuit Revives Anesthesiologist’s Whistleblower Action Alleging Upcoding of Services

The Seventh Circuit reversed December 8 the dismissal of a Wisconsin anesthesiologist’s qui tam action under the False Claims Act (FCA) against his former employer Anesthetix Management LLC and its owner TeamHealth Holdings, Inc. (collectively, TeamHealth) alleging fraudulent billing of Medicare and Medicaid for services billed to the government at a higher rate than they should have been reimbursed.
