Fourth Circuit Affirms Dismissal of Race Discrimination Claims, Revives State Law Bad Faith Claim

The Fourth Circuit affirmed January 21 the dismissal of an Indian physician’s 42 U.S.C. § 1981 claim, finding she failed to sufficiently support her allegations. The appeals court revived the physician’s claim for breach of the implied covenant of good faith and fair dealing, however, finding the district court erred in dismissing that claim.
