U.S. Court in Delaware Finds 340B HHS Opinion in Contract Pharmacy Dispute “Legally Flawed”

A federal court in Delaware refused June 16 to dismiss AstraZeneca Pharmaceuticals’ challenge to an advisory opinion issued by the Department of Health and Human Services (HHS) indicating that drug manufacturers are statutorily obligated to pass on discounts under the 340B program to health centers and safety net providers that contract with multiple pharmacies to distribute covered outpatient drugs to patients.
