Parts of Drug Rebate Final Rule Delayed for One Year, HHS Says

The Department of Health and Human Services (HHS) Office of Inspector General (OIG) is delaying for one year a controversial final rule that removes safe harbor protection under the Anti-Kickback Statute (AKS) for rebates that drug manufacturers pay to pharmacy benefit managers (PBMs) and health plans for one year pursuant to a court order issued last month.
