Fifth Circuit Says ERISA Preempts Provider’s Tort Claim Against NFL

The Fifth Circuit July 1 said a health care provider’s tort claim against the National Football League (NFL) is completely preempted by the Employee Retirement Income Security Act (ERISA). In so finding, the appeals court affirmed the lower court’s dismissal of the provider’s claims.
