U.S. Court in West Virginia Allows Malicious Prosecution, Conspiracy Claims Against Rival Exec Involved in Bringing Qui Tam Claims Against Health System

The U.S. District Court for the Northern District of West Virginia refused June 17 to dismiss claims by a putative qui tam defendant against someone who allegedly supplied erroneous information for the underlying qui tam case. The court said the health care system’s claims for malicious prosecution, tortious interference, abuse of process, fraudulent legal process, and civil conspiracy could go forward.
