OIG Oks Physician Investment in Surgery Center

Investments by a health system, manager, and several surgeons in an ambulatory surgery center (ASC) could generate prohibited remuneration under the Anti-Kickback Statute (AKS) if the requisite intent were present, but the Department of Health and Human Services Office of Inspector General (OIG) said April 29 that it would not impose administrative sanctions on the arrangement.
