Fifth Circuit Nixes Class Certification in Challenge to Louisiana Medicaid’s Alleged Policy of Not Providing Intensive Home-Based Mental Health Services for Children

On January 20, the Fifth Circuit vacated the class certification of Medicaid-eligible children in Louisiana who had been diagnosed with mental health or behavioral health conditions in an action alleging the state violated their rights to necessary treatment under the federal Early and Periodic Screening, Diagnostic, and Treatment (EPSDT) mandate.
