Eleventh Circuit Holds First-to-File Rule Bars Amended FCA Claims

The Eleventh Circuit affirmed April 1 the dismissal of a whistleblower action under the False Claims Act (FCA) finding the first-to-file rule barred the complaint. The Eleventh Circuit joined the the Second and D.C. Circuits in holding that the date the action was originally filed—and not the date of amendment—is the critical date in the first-to-file analysis.
