Seventh Circuit Rejects FCA Action Alleging Safeway Inflated “Usual and Customary” Charges

The Seventh Circuit refused April 5 to revive a whistleblower action under the False Claims Act (FCA) against Safeway, Inc. alleging the grocery store chain submitted false claims to the government by reporting its “retail” price for certain drugs as its “usual and customary” price even though many customers paid much less through various discount programs.
