U.S. Court in Utah Says Anthem Didn’t Violate ERISA, Parity Act in Denying Mental Health Treatment Coverage

The U.S. District Court for the District of Utah upheld June 21 Anthem Blue Cross & Blue Shield’s denial of residential mental health treatment for a minor based on a lack of medical necessity. In so holding, the court rejected plaintiffs’ claims under both the Employee Retirement Income Security Act (ERISA) and the Mental Health Parity and Addiction Equity Act of 2008 (Parity Act).
