U.S. Court in Illinois Says Provider May Not Sue State over Alleged Failure to Oversee Medicaid MCOs

The U.S. District Court for the Northern District of Illinois rejected a hospital’s action against the state of Illinois for allegedly failing to ensure its Medicaid Managed Care Organizations (MCOs) complied with federal payment requirements. In so holding, the court found that the Medicaid Act provisions at issue did not create a private right of action for providers to sue for alleged violations of the statute.
