Fifth Circuit Rejects DOL Advisory Opinion on Data Marketers’ Health Plan

A Department of Labor (DOL) advisory opinion finding that a proposed health insurance plan did not qualify as an employee welfare benefit plan under the Employee Retirement Income Security Act (ERISA) was arbitrary and capricious and was properly vacated by a lower court, the Fifth Circuit held August 17.
