Eighth Circuit Refuses to Declare Medicare Payment Suspension Violated Provider's Constitutional Rights

The Eighth Circuit affirmed December 6 the dismissal of a home health provider’s declaratory judgment claims finding no "actual controversy" between the provider and the government within the meaning of the Declaratory Judgment Act, 28 U.S.C. § 2201(a).
