Indiana Supreme Court Sides with Hospital in Improperly Accessed Medical Records Dispute

The Indiana Supreme Court found April 13 a defendant hospital was entitled to summary judgment on negligence claims by patients whose confidential information had been improperly accessed by a hospital employee. Although the state recognizes a tort claim for the public disclosure of private facts, the high court found that the information had not been publicly disclosed as a matter of law.
