Ninth Circuit Nixes Air Ambulance Provider’s ERISA Action Against Plan

A plan administrator properly determined that a plan participant’s air transport from Lima, Peru to Miami was not medically necessary and therefore not eligible for coverage, the Ninth Circuit ruled June 7.
