Neither the Health Insurance Portability and Accountability Act (HIPAA) nor the Family Educational Rights and Privacy Act of 1974 (FERPA) shielded from discovery certain documents in a racial discrimination claim by a former resident against a teaching hospital, the U.S. District Court for the Southern District of Texas held September 9.
