Supreme Court Will Address Government Dismissal of Qui Tam Actions

The Supreme Court said June 21 that it will review a Third Circuit decision finding the government must intervene before moving to dismiss a qui tam action, but doesn't have to do so at the outset of the litigation. The appeals court also held that the motion to dismiss must meet the standard set forth in Fed. R. Civ. P. 41(a) to be granted. Polansky v. Executive Health Resources, Inc., No. 19-3810 (3d Cir. Oct. 28, 2021).
