Seventh Circuit Rejects Home Health Care Provider’s Challenge to Overpayment for Failing to Exhaust Administrative Remedies

The Seventh Circuit held that a home health care provider could not bring a challenge to a $5.5 million overpayment determination in court because it failed to exhaust the four-part administrative process. The appeals court affirmed the district court’s dismissal for lack of subject matter jurisdiction of Simply Home Health Care’s claims that integrity contractor AdvanceMed interfered with the provider’s Medicare contracts and violated its due process rights.
