Ninth Circuit Partially Revives ERISA Action Against United over Coverage of Substance Use Disorder Treatment

The Ninth Circuit held March 24 that a plaintiff had standing to pursue a putative class action under the Employee Retirement Income Security Act (ERISA) against UnitedHealth Group, Inc. (United) for allegedly creating barriers to accessing substance use disorder care and wrongfully denying payment for treatments.
