Supreme Court to Review Decision Reviving DaVita’s MSPA Claim Against Plan for Allegedly Discriminating Against Dialysis Patients

The U.S. Supreme Court agreed November 5 to review a Sixth Circuit decision reversing the dismissal of DaVita, Inc.’s claims against an employer-sponsored health plan under the Medicare Secondary Payer Act (MSPA) for allegedly discriminating against patients with end-stage renal disease (ESRD).
