Supreme Court Should Pass on Reviewing ERISA Action Against Anthem, Express Scripts over Drug Prices, Feds Says

The federal government urged the Supreme Court to decline review of a Second Circuit decision that affirmed the dismissal of a proposed class action alleging Anthem, Inc. and Express Scripts, Inc. breached their fiduciary duties under the Employee Retirement Income Security Act (ERISA) by entering into an agreement that resulted in health plans paying higher prices for prescription drugs.
