U.S. Court in Florida Says First-to-File Rule Bars Amended FCA Claims

The U.S. District Court for the Middle District of Florida August 26 found a False Claims Act (FCA) complaint barred by the first-to-file rule. In so holding, the court sided with the Second and DC Circuits in finding that the date the action was originally filed—and not the date of amendment—is the critical date in the first-to-file analysis.
