U.S. Court in Mississippi Refuses to Dismiss Constitutional Challenge to State CON Law

The U.S. District Court for the Southern District of Mississippi January 13 allowed a plaintiff’s constitutional challenge to Mississippi's Certificate of Need (CON) program to proceed, finding, at this stage of the litigation, plaintiff plausibly alleged that the CON laws and the moratoria affecting new providers do not rationally relate to any legitimate state interests.
