Eleventh Circuit Finds Failure to Identify Specific Claim to Government Fatal to FCA Action

The Eleventh Circuit affirmed April 26 the dismissal of a False Claims Act (FCA) action, finding the relators failed to plead the submission of an actual false claim with the particularity required under Fed. R. Civ. P. 9(b) and their complaint failed to contain sufficient indicia of reliability from which to infer a false claim was submitted.
