Eleventh Circuit Rejects Medicare Secondary Payer Claims Against Liability Insurers

The Eleventh Circuit held February 22 that the Medicare Secondary Payer (MSP) Act didn’t preempt certain procedural requirements that resulted in favorable decisions for two liability insurers that were sued for allegedly failing, as primary payers, to reimburse certain Medicare Advantage Organizations’ (MAOs’) conditional payments.
