U.S. Court in New Jersey Rejects Whistleblower Action Alleging ACA Insurer Failed to Comply with State's Copay Requirements

A federal court in New Jersey dismissed March 3 a qui tam action alleging AmeriHealth Insurance Company of New Jersey (AmeriHealth) and related entities violated the False Claims Act (FCA) by falsely certifying their qualified health plans (QHPs) offered in New Jersey through the Affordable Care Act federal exchange complied with the state’s insurance laws limiting the amounts charged for network co-pays.
