Third Circuit Rejects Hospital Medicare Wage Index Challenge for Failing to Pursue Administrative Review

The Third Circuit rejected June 21 a hospital’s lawsuit over its reassignment to a geographical area with a wage index that lowered its Medicare reimbursements. Because the claim arose under the Medicare Act, it was subject to the statutory channeling requirement, and the hospital had to pursue administrative adjudication before filing an action in court, the Third Circuit said.
