U.S. Court in Michigan Finds Physician’s FCA Retaliation Claim over Privileges Denial Time-Barred

An alleged retaliation for purposes of triggering the three-year statute of limitations under the False Claims Act occurred when a final decision denying a whistleblower physician’s renewal of medical staff privileges was made and not when a letter communicating that decision was sent to him, the U.S. District Court for the Southern District of Michigan held June 1.
