U.S. Court in Pennsylvania Dismisses Informed Consent Claim in Eye Exam Dispute, Allows Emotional Distress Claim

The U.S. District Court for the Eastern District of Pennsylvania dismissed September 1 a patient’s lack of informed consent claim, finding the patient’s failure to present expert testimony was fatal to the claim. The court allowed, however, a narrow emotional distress claim to go forward as that claim didn’t require expert testimony.
