Eighth Circuit Strikes Jury Verdict Against Spinal Surgeon, Distributor in FCA Action

The Eighth Circuit reversed a jury verdict against a neurosurgeon and his fiancée, who ran a spinal implant distributorship, and remanded for a new trial in an action alleging they violated the False Claims Act (FCA) by engaging in an illegal kickback scheme that “tainted” claims submitted to Medicare and Medicaid.
