Second Circuit Says Lower Court Must Determine Subject Matter Jurisdiction Before Dismissing FCA Claims

The Second Circuit vacated June 3 a lower court’s dismissal of a False Claims Act (FCA) action, finding the lower court must first resolve the jurisdictional issue of whether the action is allowed under the FCA’s public disclosure bar.
