California Appeals Court Dismisses Action Alleging Hospital Failed to Disclose Evaluation and Management Services Fee

Although a hospital failed to disclose material facts regarding how it determined the amount of the emergency room evaluation and management services (EMS) fee it charged patients, a proposed class of patients charged the fee could not sustain a cause of action under California’s Consumer Legal Remedies Act (CLRA) because they couldn’t establish all the required elements of their claim, a California appeals court held April 14.
